The Emilia Romagna Region obtained the upholding of its appeal before the Court of Cassation, which established the principle that the compensation provided for in Article 17 of Emilia Romagna Regional Law No. 8 of 1994, for damage caused by wildlife, presupposes the occurrence of the conditions expressly identified by the aforementioned provision, which limit regional intervention to specific territorial areas faunal types; consequently, by virtue of paragraph 3-ter of Art. 17, to be qualified as a rule of authentic interpretation, also applicable to pending judgments, damage caused by huntable species (in this case, wild boar) in areas where hunting is permitted cannot be compensated through the regional fund.
